Linkedin article – Registered vs Authorised AIFMs in Luxembourg. Why the Distinction Matters
In this LinkedIn article we sheds light on an important regulatory topic: the distinction between registered and authorised AIFMs under Luxembourg law.
The Luxembourg fund ecosystem includes both registered and authorised AIFMs, but these two regimes are not equivalent. Under Article 3 of the AIFMD (2011/61/EU), registered AIFMs operate under a lighter framework with limited regulatory obligations. In contrast, authorised AIFMs are fully supervised by the CSSF, subject to comprehensive governance, risk, compliance, and reporting standards, and are eligible to passport their services across the EU.
Key takeaway: While registered AIFMs have their place, authorised AIFMs provide the infrastructure and safeguards that institutional investors require, independent valuation, depositary oversight, external audit, and robust internal controls.
At 6 Monks (6M), we are proud to operate as a fully authorised AIFM, enabling our clients to launch and manage regulated crypto and private equity funds with full confidence in cross-border compliance and investor protection.
